These terms govern the use of Disposable Camera (the "Service"), operated by SiteApp Creators (BE 1009.995.969, siteappcreators@gmail.com). By creating an account, creating an album, or scanning a QR code to use the camera feature, you agree to these terms.
1. The service
Disposable Camera lets an organizer create a private, shareable album for an event. Guests scan a QR code to open a browser-based camera, capped at a fixed number of shots per guest, with no preview and no download for guests. Every shot is uploaded directly to the organizer's private album.
2. Accounts (organizers)
- You must provide an accurate email address and keep your login details confidential.
- You must be at least 18 years old, or have a parent/guardian's consent, to create an account.
- You are responsible for all activity that happens under your account.
3. Organizer responsibilities
As the person creating an album for your own event, you are responsible for:
- Letting your guests know, in some reasonable way (e.g. a sign near the QR code), that photos they take will be collected into a private album you control.
- Having a lawful basis to collect and keep photos of the people at your event, the same way you would if you handed out disposable film cameras.
- Not using the Service to collect or store illegal, abusive, or infringing content, or content involving minors in an inappropriate context.
- Complying with applicable data protection law (such as the GDPR) for the photos in your album, since you control what happens to them after the event.
4. Guest use of the camera
No account is required to use the camera feature. By scanning a QR code and taking a photo, a guest agrees that:
- The photo is uploaded directly into the organizer's private album.
- The guest will not be able to preview, retrieve, or delete that photo themselves.
- Each device is limited to the number of shots the organizer has set for that album.
- Attempting to bypass shot limits, or the camera's intended behaviour, is not allowed.
5. Acceptable use
You agree not to use the Service to:
- Upload or collect unlawful, hateful, harassing, or sexually explicit content involving minors.
- Infringe someone else's intellectual property or privacy rights.
- Attempt to disrupt, reverse-engineer, or overload the Service.
- Resell or sublicense access to the Service without our written consent.
We may suspend or remove an account or album that violates these terms.
6. Ownership of photos
Photos taken through the Service remain the property of the guest who took them and/or the organizer whose album they land in, as agreed between the two of you. You grant us a limited license to store, process, and display those photos solely to operate the Service (e.g. showing them in the organizer's album).
7. Pricing and payment
Some plans may be free and others paid, as shown on our pricing page at the time of purchase. Paid plans are billed per event/album, not as a recurring subscription, unless stated otherwise at checkout. Because access to a paid album is typically used immediately for an event, once an album has started collecting photos we may not be able to offer a refund for that album, in line with the exceptions to the right of withdrawal for digital services under Belgian consumer law (Book VI of the Code of Economic Law). 8. Availability and liability
We do our best to keep the Service available and photos safe, but we provide the Service "as is" and cannot guarantee uninterrupted availability or that no data will ever be lost (e.g. due to a technical failure). To the maximum extent permitted by law, our liability for any damage arising from your use of the Service is limited to the amount you paid us for the album in question in the 3 months before the event giving rise to the claim. Nothing in these terms limits liability that cannot be excluded under Belgian law (such as liability for fraud or gross negligence).
9. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate access to an account that breaches these terms, with notice where reasonably possible.
10. Changes to these terms
We may update these terms from time to time. If we make material changes, we will update the "last updated" date above. Continuing to use the Service after changes take effect means you accept the updated terms.
11. Governing law
These terms are governed by Belgian law. Any dispute that cannot be resolved amicably will be submitted to the competent courts of Ostend, Belgium, without prejudice to any mandatory consumer-protection rules that apply in your place of residence.
